Version 1.0 in force as of October 28, 2026

Article 1: Definitions

Service: the Flowermes platform, available at https://www.flowermes.com, which lets you create and send a digital card.

Card: the three-dimensional digital flower, together with a written message and, if the Customer wishes, a voice message, which the Customer sends to a Recipient.

Customer: any adult individual who orders a Card.

Recipient: the person to whom the Customer sends the Card.

Seller: Kevalco, a SAS with a share capital of 2 500,00 €, registered under 994 157 576 R.C.S. La Roche sur yon, with its registered office at 4 Le Pommeragu, 85260 Montreverd, France.

Article 2: Purpose

These General Terms of Sale (GTS) govern the contractual relationship between the Seller and the Customer for the sale of Cards through the Service. They are supplemented by the General Terms of Use of the Service.

Article 3: Description of the Card

A Card includes:

  • a 3D flower that the Recipient can rotate;
  • a written message of up to 500 characters;
  • optionally, a voice message of up to 60 seconds;
  • delivery by e-mail, or by a link and QR code to share.

The Card opens in a browser, with no account and nothing to install. It remains accessible for 6 months, as set out in Article 10.

Article 4: Price

The price of a Card is 1,99 € including all taxes. It is a one-time payment: there is no subscription and no renewal.

The price is expressed in euros and includes VAT at the applicable rate. The price displayed when the order is placed is the price payable. The Seller may change its prices at any time; the price that applies is the one in force on the date of the order.

Article 5: Ordering

Orders are placed online, without creating an account, as follows:

  • choosing the flower;
  • writing the message and, if desired, recording the voice message;
  • entering the Recipient's first name and the delivery method (e-mail or link);
  • entering the Customer's first name and e-mail address;
  • accepting the two required consents: immediate supply of the digital content with waiver of the right of withdrawal (Article 8), and acceptance of these GTS and of the Terms of Use;
  • secure payment.

The contract is concluded when the payment is confirmed. A receipt is sent to the Customer by e-mail.

A card being created is kept for 7 days in the Customer's browser so they can resume their order, and is then deleted.

Article 6: Payment

Payment is made by bank card when the order is placed. Payments are processed by Stancer; the Customer's bank details are never stored by the Seller.

If the payment fails, no amount is charged and the Card is not sent. The Customer may try again.

If a charge appears without a receipt being received, the Customer should not pay a second time but contact the Seller at hello@kevalco.com.

Article 7: Delivery of the Card

The Card is sent as soon as the payment is confirmed, usually within 20 seconds. Depending on the chosen method:

  • E-mail: the Recipient receives a message containing the link to the Card;
  • Link or QR code: the Customer receives the link and the QR code, and passes them on themselves.

The Customer is responsible for the accuracy of the Recipient's e-mail address. A Card sent to an incorrect address entered by the Customer is neither resent nor refunded, unless the error is the Seller's. Receipt of the e-mail depends on the Recipient's mail provider, which is independent of the Seller.

The link to the Card is personal and secret: anyone who has it can open the Card. The Customer is responsible for how they use it.

Article 8: Right of withdrawal

The Card is digital content supplied on a non-tangible medium, and its performance begins as soon as the payment is confirmed.

Under the consumer law applicable in France (Article L221-28, 13° of the Consumer Code) and the equivalent European rules, a consumer Customer has no right of withdrawal when performance has begun with their prior express consent and they have acknowledged that they lose their right of withdrawal.

Before paying, the Customer expressly consents to the immediate supply of the Card and acknowledges losing their right of withdrawal by ticking the box provided for that purpose. The Seller confirms this consent and waiver by e-mail, together with the order receipt.

This waiver does not deprive the Customer of the legal guarantees set out in Article 9.

Article 9: Guarantees and refunds

The Seller must supply a Card that conforms to the one ordered, in accordance with the legal guarantees applicable to digital content.

If the Card was not delivered, or does not work for a reason attributable to the Seller, the Customer may request by e-mail at hello@kevalco.com, stating the e-mail address used for the order:

  • that the Card be resent or brought into conformity;
  • failing that, a full refund of the price paid, by the same means of payment, within 14 days of the request.

No refund is due where the Card was correctly supplied and the Recipient did not look at it, where the Customer made an error entering the Recipient's details, or where the Card was removed for content that breaches the Terms of Use (Article 11).

Article 10: Availability period and deletion

The Card is accessible for 6 months from the date it is sent. After that period the Card is deleted: the written message, the voice message and the Recipient's contact details are erased.

The Customer may ask for their Card to be deleted earlier by writing to hello@kevalco.com.

Billing and payment data needed for accounting and tax obligations are kept for 10 years.

Article 11: Content of the Card

The Customer is solely responsible for the content of their Card (written message, voice message) and for the data they enter. They declare that they hold the necessary rights and comply with the content rules of the Terms of Use.

The Seller may deactivate or delete a Card whose content is unlawful or contrary to the Terms of Use, in particular following a report. In that case, no refund is due.

Article 12: Availability and liability

The Service is available 24/7, subject to maintenance operations and interruptions beyond the Seller's control. The Seller aims for 99% availability on a monthly basis, without this figure being a guarantee.

To the extent permitted by law, the Seller is not liable for indirect damages, and its liability is limited to the price paid for the Card concerned. These limits do not apply to the rights a consumer Customer holds by law, nor in the event of the Seller's gross negligence or wilful misconduct.

Article 13: Invoicing

A receipt is sent to the Customer's e-mail address for each order. The Customer may request an invoice in their name by writing to hello@kevalco.com. Accounting documents are kept for 10 years.

Article 14: Support and complaints

Support is available by e-mail at hello@kevalco.com. The Seller undertakes to reply within 48 working hours. In the event of a dispute, the parties will try to reach an amicable solution before any legal action.

Article 15: Personal data

The processing of personal data is described in Article 8 of the General Terms of Use, in accordance with the General Data Protection Regulation (GDPR). The Customer has the rights of access, rectification, erasure, restriction, objection and portability by writing to hello@kevalco.com.

Article 16: Consumer mediation

In accordance with Articles L.616-1 and R.616-1 of the French Consumer Code, a consumer Customer may use a consumer mediator free of charge to resolve any dispute relating to these GTS amicably.

The designated mediator is:

Mediation is optional.

Article 17: Governing law and jurisdiction

These GTS are governed by French law. A consumer Customer residing in the European Union keeps the benefit of the mandatory consumer protection provisions of their country of residence.

In the event of a dispute, the parties will try to reach an amicable solution. Failing that, a consumer Customer may bring the matter before the court with territorial jurisdiction under the rules of the Consumer Code. For a Customer acting in a professional capacity, the Commercial Court of La Roche-sur-Yon has sole jurisdiction.

Article 18: Changes to the GTS

The Seller may change these GTS at any time. The GTS that apply to an order are those in force on the date of that order.

Article 19: Force majeure

The Seller is not liable for failing to perform its obligations in the event of force majeure as understood in French case law, including natural disaster, war, riot, a strike affecting an essential third-party service, a major internet infrastructure failure or a large-scale cyberattack.

Article 20: Contractual documents

These GTS are supplemented by the General Terms of Use (GTU), which govern access to and use of the Service and which describe the processing of personal data.
